• Fifth Amendment, the Пятая поправка ( к Конституции США). Определяет порядок судопроизводства и право обвиняемого не отвечать на вопросы обвинения (тж. поправка о «надлежащей правовой процедуре» [due process amendment]). Основным положением этой статьи является «право на молчание» [‘right not to speak']. 3 FIFTH AMENDMENT
Im Fifth Amendment, dem fünften Zusatz zur Verfassung der USA, wurden verschiedene Grundrechte zum Schutz der Bürger vor Übergriffen des Staates festgeschrieben. Es besagt unter anderem, dass niemand ohne Gerichtsverhandlung inhaftiert werden darf, dass niemandes Eigentum ohne ordentliches Gerichtsurteil gepfändet werden kann, dass niemand zweimal wegen desselben Verbrechens angeklagt werden darf und dass niemand gegen sich selbst aussagen muss. Wenn jemand die Aussage verweigert, um sich nicht selbst zu belasten, so nennt man das auch "he/she is taking the Fifth". 5 Fifth Amendment
Инкорпорированная [ incorporation doctrine] поправка к Конституции США [ Constitution, U.S.], ратифицирована 15 декабря 1791. Поправка гласит: "Ни одно лицо не должно привлекаться к ответственности за преступление, караемое смертью, либо за иное позорящее преступление иначе как по представлению или обвинительному заключению большого жюри, за исключением дел, возбуждаемых в сухопутных или морских частях либо в милиции, находящихся на действительной службе во время войны или опасности, угрожающей обществу; равным образом ни одно лицо не должно за одно и то же правонарушение дважды подвергаться угрозе лишения жизни или телесного наказания, не должно принуждаться в каком-либо уголовном деле свидетельствовать против себя, не должно лишаться жизни, свободы либо собственности без надлежащей правовой процедуры; частная собственность не должна изыматься для общественных нужд без справедливого вознаграждения" ["No person shall be held to answer for a capital, or otherwise infamous crime, unless on a presentment or indictment of a Grand Jury, except in cases arising in the land or naval forces, or in the Militia, when in actual service in time of War or public danger; nor shall any person be subject for the same offence to be twice put in jeopardy of life of limb; nor shall be compelled in any criminal case to be a witness against himself, nor be deprived of life, liberty, or property without due pricess of law; nor shall private property be taken for public use, without just compensation" (infamous crime)].
